General Terms and Conditions

1. SCOPE

1.1. These General Terms and Conditions (“General Conditions”) govern and are an integral part of the service agreement entered into through the website www.sjhotel.pt (“Site”), between Pés Na Terra Lda., Legal person nº 508576571 manager of the SJ hotel and the client signing the contract (“Client”), whose object is the provision of tourist accommodation reservation services (“Accommodation”).

1.2. The General Conditions apply to the contract signed by the Client for the provision of accommodation reservation services with Hotel SJ by electronic means (e-mail) or in person.

1.3. The General Conditions are a complement to any particular conditions agreed in writing between the Client and the Hotel regarding the object of the Contract, referred to in a specific area of the Site for a specific product or service, or included in the proof of booking or order ("Particular Conditions"), which are also an integral part of the Contract.

1.4. The provisions of the Particular Conditions prevail, in case of conflict, over the General Conditions, prevailing over any conditions agreed between the Client and Hotel SJ.

1.5. The conclusion of the Contract takes place with the written confirmation of the reservation or under the terms of these General Conditions.

1.6. It is understood that when making the reservation the Client accepted these General Conditions, the conditions and characteristics of the Accommodation and reserved services, rates and forms of payment, as well as the Particular Conditions and any other additional written stipulations specially agreed between the Client and the Hotel during booking processing.

2. RESERVATIONS

2.1. When booking any reservation, the Client must correctly indicate the dates of arrival and departure, applicable rate (always subject to availability confirmation by the hotel), as well as his personal data and payment information, taking full responsibility for the choices made and for the information provided, which must be complete, true and updated.

2.2. The Client assumes full responsibility for the possession and / or obtaining of the necessary documents (such as identification documents, authorizations and visas) for entry into the country and / or locality where the Hotel SJ is located and must inform himself in a timely manner about this before make the reservation. Pés Na Terra does not assume any responsibility for refusing to grant visas or permission to enter the Client in the country.

2.3. No refunds are due for goods and / or services which, although made available to the Client under the Contract, the Client chooses not to enjoy or use.

2.4. The use of fraudulent mechanisms to obtain benefits, promotions or discounts makes the Client responsible and gives the Hotel the right to cancel the reservation.

3. PRICES AND TAXES

3.1. Os preços indicados para os bens e serviços são em euros e poderão sofrer oscilações para uma mesma data, considerando-se ser o valor contratual, o valor em vigor à data e hora da reserva.

3.2. The reservation price includes Value Added Tax (VAT) at the legal rate in force, depending on the services contracted.

3.3. In case of a reservation subject to prepayment at the time of booking, it is up to the customer to inform the data to be included in the invoice for prepaid services, these data being the sole responsibility of the Customer. The invoice once issued cannot be canceled.

4. ACCOMMODATION

4.1. The characteristics of the accommodation units are those contained in the terms of the reservation or the Site. However, as the photographs were not taken on the day the reservation was made, there may be insubstantial differences between the photograph and the reality in the data on the use of the accommodation units, which do not give the Customer or the right to any form of reservation.

4.2. The prices shown are per room, however, they are shown per person. If it is possible to use a reservation for a number of people higher than the normal accommodation capacity, you may have the limit of an extra bed, which may not have the same comfort and quality as other beds in the accommodation, reducing its useful area , or even with children's beds.

4.3. If the Client presents himself with more people or people of different ages than those indicated in the reservation to use the Accommodation, those responsible for the Hotel may refuse their entry or charge a fee, if accommodation is available.

4.4. If an overbooking situation occurs (that is, more reservations than available accommodation) at the Hotel, the Client expressly acknowledges and agrees to be placed in another Hotel of the same category (in any case, ensuring that the quality of the Accommodation provided is not lower than that of the Accommodation reserved by the Customer), at no additional cost to the Customer, and without, for that reason, being entitled to any compensation or termination of the Contract.

4.5. Accommodation can be used from 15:00 on the day of arrival and must be left free before 12:00 on the day of departure (in both cases, at local time). Staying in the accommodation after the departure time may lead to the payment of additional amounts, which are the sole responsibility of the Client.

4.6. At the request of the client and subject to availability and express confirmation from the Hotel, it may be agreed to anticipate the time of entry on the day of arrival or to extend the time of departure on the day of departure, with or without additional costs for the client, under the terms of Particular conditions of the contract and without prejudice to the application of the General Booking Conditions.

4.7. Access to the rooms is restricted to the Client and persons included in the reservation confirmed by the Hotel. Guests, as well as service providers outside the Hotel (takeaway companies, etc.), must be received by the Client at the reception.

4.8. The Client must comply with any internal rules and / or regulations for the use of the Services, and the Hotel cannot be held responsible for losses suffered by the Client as a result of their breach by the Client.

5. PAYMENT

5.1. The payment of the reservation must be made by the Client on the date of realization of the same or on the date of entry into the accommodation unit (if this modality is available for the type of reservation made by the Client), in order to enjoy the contracted reservation.

5.2. If the Client intends to pay the reservation only at the Hotel, he can do so, and must inform himself in a timely manner about which payment methods are accepted. However, credit card information may always be requested when making the reservation, for the purpose of guaranteeing the reservation, the Hotel undertaking to charge it for the amount corresponding to the value of the first night booked, only if the Client does not show up at the Hotel, on the date of entry indicated on the booking receipt or cancels the reservation without the advance notice provided on the respective booking receipt, which the Client expressly accepts and authorizes.

6. CANCELLATION POLICY

6.1. When making a reservation on the Hotel SJ website, the customer accepts and agrees with the cancellation and no-show conditions at the establishment.

6.2. The deadline for canceling a confirmed reservation is 24 hours before check-in.

6.3. If the cancellation occurs within the aforementioned deadline, the amounts that may have been deposited for the reservation will be returned by the Hotel to the Client, after deducting bank charges.

6.4. In case of cancellation after the stipulated limit, the hotel reserves the right to charge the amounts previously stipulated or not to refund the prepaid amounts.

6.5. Reservations are guaranteed and rooms are reserved until 11 pm on the scheduled arrival date. After that time and if there is no communication from the customer, the reservation will be canceled automatically, without the possibility of refund and regardless of the number of nights booked.

7. RESPONSIBILITY

7.1 Pés Na Terra Lda. - Hotel SJ is accountable to Customers under the terms of the law, unless:
a) The non-compliance is not due to situations of force majeure or unforeseeable circumstances, motivated by abnormal and unpredictable circumstances, outside the Hotel, whose consequences cannot have been avoided despite all the steps taken;
b) It is demonstrated that the non-compliance is due to the Client's own conduct or the unpredictable performance of a third party, unrelated to the provision of the installments due by the Contract.

7.2. To the extent permitted by applicable law, the Hotel is not responsible for damages that may arise from any unforeseen circumstances or that are beyond its control, and also, expressly and by way of example: network delays or blockages, interference, interruptions, viruses, malfunctions and / or disconnections in the operational operation of the Site or in the Client's computer equipment and equipment, or any other anomalous operation of the reservation service for causes beyond its control and which prevent the reservation from being made.

7.3. The Customer is accountable to Pés Na Terra Lda. - Hotel SJ under the terms of the law.

8. PERSONAL DATA

When processing the reservation, the Client will be asked for certain data that can identify him (“Personal Data”), which will be collected by the Hotel in strict compliance with the law and in accordance with the provisions of the Privacy Policy.

9. CONTACT

All communications or notifications under the Contract must be made using the information provided by the Client in processing the reservation. Any changes to the Client's data and any communication or notification sent by the Client to the Hotel must be made to the following contact: reservas@sjhotel.pt.

10. GENERAL PROVISIONS

10.1. Once the Contract has been signed, it can only be changed in writing, by a document signed by the Client and the Hotel management, which becomes an integral part of it.

10.2. The provisions of these General Conditions may be changed at all times by Pés Na Terra Lda. - Hotel S.J. for future legal relationships, without prior notice. As such, whenever you make a reservation, and even if you use the Site frequently, you should read them in full.

11. APPLICABLE LAW AND JURISDICTION

The Contract is governed by the laws of the Republic of Portugal. For the resolution of any disputes arising from the validity, execution, execution, non-compliance, extinction or interpretation of the Contract, the Tondela County Court is exclusively competent, without prejudice to the applicable mandatory legal rules.
